DFARS Final Rule Adds Policy on Subcontract Reporting

The Department of Defense has finalized, with technical changes, the DFARS Case 2009-D002 interim rule ( ¶70,016.600) that amended the Defense Federal Acquisition Regulation Supplement to conform DFARS Electronic Subcontracting Reporting System policy and procedures to the FAR. The interim rule provided DoD-specific policy and procedures related to the eSRS. A final rule (FAR Case 2005-040) issued with Federal Acquisition Circular 2005-42 revised the FAR to reflect use of the eSRS, rather than Standard Form 294—Subcontract Report for Individual Contracts, and Standard Form 295—Summary Subcontract Report, for submission of small business subcontract reports. Accordingly, the interim rule amended the prescription provision at DFARS 219.708 to prescribe use of revised DFARS 252.219-7003, Small business subcontracting plan (DoD contracts), and newly-added DFARS 252.219-7004, Small business subcontracting plan (test program). The rule also amended DFARS Appendix I, Policy and Procedures for the DoD Pilot Mentor-Protégé Program, at DFARS Appendix I-105, DFARS Appendix I-112.1, and DFARS Appendix I-112.2, and made a technical amendment to DFARS 252.212-7001. DoD did not receive any responses to the rule, but the final rule makes a technical change to DFARS 219.708. For the text of the final rule, effective February 28, 2013, see ¶70,016.744.
