EBSA clarifies that “spouse” and “marriage” are determined by state in which same-sex marriage was recognized

The EBSA has released new guidance interpreting the Supreme Court’s decision in United States v. Windsor, in which the High Court struck down certain provisions of the Defense of Marriage Act that had the effect of denying federal benefits to legally married, same-sex couples. Delivery of summary prospectus to second fiduciary satisfies prospectus distribution conditions of PTE 77-4

In an advisory opinion, the Employee Benefits Security Administration (EBSA) has concluded that the delivery of a summary prospectus satisfies the prospectus distribution requirements solely for purposes of section II(d) of Prohibited Transaction Class Exemption 77-4.
