Employee failed to show he engaged in conduct protected by ERISA or FLSA, Eighth Circuit rules

An employee terminated after receiving three formal written warnings about his job performance and conduct could not maintain a retaliation action under ERISA or the FLSA, ruled the Eighth Circuit, affirming a lower court’s grant of summary judgment in favor of his employer. Aon Hewitt provides tips for workers to consider this open enrollment season

U.S. employees soon will be asked to make decisions about their 2013 benefits during open enrollment season. According to Aon Hewitt, the benefits offered to employees next year may be impacted by a number of factors, including rising health care costs, the declining health of the population, and phase-in of provisions under the Patient Protection and Affordable Care Act (PPACA). A new excepted benefit category for stand-alone health reimbursement arrangements (HRA) should be created, according to a letter from the Employers Council on Flexible Compensation (ECFC) to the Secretaries of Health and Human Services, Treasury, and Labor (Departments).
