Accidental overdose of prescription medicine is not “intoxication,” Eighth Circuit rules
An insurer failed to establish, by objective evidence, that an insured’s death was not accidental, the Eighth Circuit has ruled. Therefore, the insurer was required to pay the plan’s accidental death benefit. For details, see ¶2074J.
Redefine ACA’s definition of full-time employee to 40 hours per week, hearing witnesses say
Reductions in employees’ hours, increased costs, and reporting burdens are some of the consequences for employers as a result of the Patient Protection and Affordable Care Act’s (ACA) definition of full-time employee, according to witnesses at a House Committee on Ways and Means hearing on the impact of the definition on jobs and opportunities. Employee provided “care for” terminally ill mother within meaning of FMLA on final family vacation, Seventh Circuit rules
The FMLA applied when an employee requested leave to care for a terminally ill parent while that parent was traveling away from home, ruled the Seventh Circuit. The appeals court concluded that such an employee was seeking leave “to care for” a family member within the meaning of the Act. For more information, see ¶2074L.
ACA exchange offerings compare favorably to employer plans
Health insurance plans offered this year on the ACA’s exchanges in some ways represent a better value than similar employer-based plans, according to survey results obtained by PwC’s Health Research Institute (HRI). For more information, see ¶2074N.

PBGC uses partition authority to pay benefits to former Hostess Brands employees
Using its partition authority, the PBGC will pay retirement benefits for nearly 350 former Hostess Brands employees who were members of the Bakery and Sales Drivers Local 33 Industry Pension Fund, a distressed multiemployer plan in Baltimore. For more information, see ¶125U.
