HHS issues final rule to strengthen HIPAA provisions

The HHS Office of Civil Rights (OCR) has issued an advance release of a final rule that amends HIPAA’s Privacy, Security, and Enforcement Rules as mandated by the Health Information Technology for Economic and Clinical Health Act (HITECH Act), enacted as part of the American Recovery and Reinvestment Act of 2009 (ARRA), and Sec.105 of Title I of the Genetic Information Nondiscrimination Act of 2008 (GINA). HHS awards $1.5 billion to fund the building of state health insurance exchanges

Several states will receive approximately $1.5 billion in new Exchange Establishments grants to help implement the Patient Protection and Affordable Care Act’s (ACA) mandate to establish state insurance exchanges or marketplaces. For details, see ¶2064G.

No injunction available in private action to enforce MSP obligation, federal district court rules

An insured’s action for an injunction directing his former insurance carrier and plan administrator to continue his long-term disability (LTD) coverage and adhere to Medicare Secondary Payment (MSP) requirements was dismissed by a federal district court because injunctive relief is not available in a private action to enforce Soc. Sec. Act Sec. 1862 against the alleged primary payer. For more information, see ¶2064H.

March 1, 2013 deadline for compliance with FLSA Sec. 18B notice provisions is extended by EBSA

The Employee Benefits Security Administration (EBSA) has announced that the notice requirement of Fair Labor Standards Act (FLSA) Sec. 18B will not take effect on March 1, 2013, as originally planned. For more information, see ¶2064J.
