House Ways and Means Committee Chairman believes Supreme Court ruling opens way for new taxing powers

House Ways and Means Committee Chairman Dave Camp, R-Mich., on July 10 declared that the Supreme Court’s ruling that the individual mandate in the Patient Protection and Affordable Care Act ACA) is constitutional will eventually allow Congress dangerous new taxing powers. For details, see ¶2059F.

Summary of Benefits and Coverage deadline is two months away for some plans

After the Supreme Court’s historic upholding of the Affordable Care Act (ACA), U.S. employers are looking at the next set of milestone regulations and seeking the most efficient way to comply. A major requirement — just several months away —is the Summary of Benefits and Coverage (SBC), required to be in effect for open enrollment periods beginning on or after September 23, 2012. The Center for Consumer Information & Insurance Oversight (CCIIO) has issued additional guidance on the medical loss ratio (MLR) reporting and rebate requirements. CCIIO Technical Guidance 2012-0005, issued on July 17, 2012, provides MLR guidance on the notice of rebate, notice of MLR information, and the definition of plan document. For details, see ¶2059H.

Interest in private insurance exchanges, “defined contribution” plans likely to increase due to health reform

Federal health care reform legislation and the desire of employers to limit their health insurance costs are likely to fuel interest in “defined contribution” (DC) health benefits and private health insurance exchanges, according to a new report published in the July EBRI Issue Brief from the nonpartisan Employee Benefit Research Institute (EBRI).
